Terms of Service For Commissions

In commissioning artwork from me, you agree to abide by these terms of service.
If commissioning art with adult content you are confirming that you are 18 years of age or older and can legally view and possess adult content.
I have the right to reject any commission that I do not feel comfortable drawing for any reason.
All drawings will include a subtle signature that you may not remove.
I do not accept commissions to alter, edit or recolor art created by other artists.
I will only accept commissions of someone else's characters if I receive permission from the owner via email. This is to avoid any possible issues that could arise.
I do not offer privacy fees or accept “private image” commissions and reserve the right to post the commission publicly.
I shall accept posting on a later date due to gifts for birthdays/special days.
Buyer, if requested, may remain anonymous when image is posted publicly.
I might record/stream the drawing process on Picarto.tv.

Currency accepted is either USD or CAD (prices listed on Commissions are USD) and can be paid through PayPal Invoice/Paypal.me.
Commissions must be paid 100% up front after approval of initial sketch and before artwork begins unless previously discussed otherwise.
Do not send me any payment before I have agreed to give you a slot and sent you the Invoice, it will be immediately refunded.
Payment must be made within 24 hours of invoicing or I may cancel the commission.

All commission requests must be done via skyeboldcommissions@gmail.com which I will contact you from after submitting the form on this website.
I will not discuss commission details through chats, forums or private messages.
When requesting a commission please provide a clear reference(s) of the character with a brief description via direct linking or an email attachment.
Include pose, facial expression, clothing, accessories and any small details in your description.

The time it takes to finish your commission varies 1 week - 3 months depending on factors such as volume of previous work/commissions, health, and the complexity of the piece.
If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap.
Once the piece is finished you will receive, via email attachment, the full-resolution image for personal viewing along with a web-friendly size for sharing. Note that there is no physical product.

A single sketch review will always be sent to allow the client to make a few minor adjustments (facial expression, dialogue etc) before continuing the piece (this will include a watermark and be smaller than the finished piece).
If I do not receive a response within 24 hours for the sketch review, I shall continue the image as-is. The quicker you approve, the faster I can continue with your image.
If other revisions or adjustments are requested a fee will be required depending on the complexity (unless I find that the revision is due to a mistake I have made).
I reserve the right to decline further revisions if the request for change is too great.
To prevent misunderstanding and large revisions, please be specific in your initial commission description.

The buyer is not allowed a refund or cancellations after payment.
If for any reason I am unable to start/finish your commission you will receive a full refund.
If you are getting a refund, DO NOT request a Paypal charge back. I will transfer the money back to you myself.
If you request a Paypal charge back at any point when you are not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it. I will decline the charge back and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me again.

I, SkyeBold (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:

Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
Print the artwork (not for sale purposes) and claim the character(s) as their own, but not the artwork itself.

Reproducing/using the copyrighted artwork commercially- means making money off of it in any way.
Claiming the artwork as your own.
Removing my signature from the artwork.
Altering the artwork without my consent.
